These Terms and Conditions govern use of sunswiftsoft.com and development and maintenance services supplied by Sunswift Software Solutions.
1. Business identity
Sunswift Software Solutions is a sole proprietorship owned by Nalla Santosh Choudhury.

“We”, “us”, and “our” refer to Sunswift Software Solutions. “You” refers to the website user or customer, as applicable.
2. Eligibility and agreements
Our services are intended for customers aged 18 or above who can legally enter into a contract. Anyone acting for an organisation must have authority to bind it.
Every paid development project requires a written quotation or agreement accepted by the customer. It defines the scope, price, payment milestones, delivery schedule, revisions, and support period.
Specific terms in an accepted agreement take precedence over these general Terms where lawful. Our Privacy Policy and Refund and Cancellation Policy apply to their respective subjects.
Nothing in these Terms removes rights or remedies that cannot lawfully be excluded.
3. Services and portfolio
Our launch services comprise website development, web application development, and Android application development. Maintenance is provided under a separate agreement.
Sunswift Solar, ULA Data Management, and Expense Tracker are portfolio projects operated by Sunswift Solar. Their availability, use, and operational policies are governed separately by their operator.
SaaS subscriptions and online checkout are not available at launch. Future offerings will have their own applicable terms before purchase.
4. Scope and customer responsibilities
Only the work described in the accepted quotation or agreement is included.
You must provide accurate requirements, necessary content and access, timely approvals, and feedback. You must hold the rights and permissions needed for materials and information supplied to us.
Changes to scope may affect price and delivery. Material changes require agreement before additional work proceeds.
If required inputs or approvals are delayed, we will communicate any resulting effect on the schedule.
5. Delivery, review, and support
Delivery is digital through agreed channels, such as deployment, repository access, account provisioning, or file transfer. Physical shipping does not apply.
Delivery dates, review procedures, revisions, and acceptance criteria are specified in the accepted agreement. Silence does not automatically constitute acceptance unless an appropriate process has been expressly agreed.
The support and defect-correction period is specified in each quotation. Ongoing maintenance requires a separate agreement.
App-store approval and other third-party decisions remain subject to the relevant provider’s rules.
6. Prices and payment
Advance payments, payment milestones, charges, and applicable taxes are set separately in each accepted quotation.
We accept bank transfers and UPI payments. Online checkout is disabled.
Customers must pay undisputed amounts according to the agreed schedule. Please raise invoice disputes promptly with supporting information.
We may pause affected work for overdue undisputed payments after reasonable notice and an opportunity to resolve the issue. Any late charge must be expressly agreed and lawful.
Cancellation and refunds follow our Refund and Cancellation Policy and lawful project-specific terms.
7. Domains, hosting, and third-party purchases
Customers may purchase domains, hosting, and licences directly. We may purchase them on a customer’s behalf with prior written approval.
The agreement should identify ownership, account control, renewal responsibilities, charges, and applicable third-party terms.
Third-party and open-source components remain subject to their respective licences. We do not control independent providers’ availability or approval decisions, but remain responsible for our own agreed work.
8. Intellectual property
You retain ownership of materials you provide.
After full payment, you own the custom code and designs created specifically for your project, subject to the accepted agreement and third-party rights.
We retain ownership of pre-existing tools and reusable components. Where these are incorporated into a deliverable, we grant the permissions reasonably necessary to use the deliverable for its agreed purpose, subject to any restrictions disclosed and accepted before purchase.
The agreement identifies the handover materials, including source code and documentation. Purchasing development services does not transfer ownership of independent third-party software.
We will obtain permission where required before using confidential project information or customer branding in public portfolio material.
9. Confidentiality, data, and AI tools
Both parties must protect confidential information received through the engagement and use it only for authorised purposes. This does not prevent disclosures required by law or the lawful use of information independently obtained or already public.
We use test data unless the customer gives written authorisation for access to live customer or end-user data.
Customer content, source code, credentials, or personal information will be used with third-party AI tools only with the customer’s prior written approval and appropriate safeguards.
Employees and freelance developers may access project information only as needed for their work and under confidentiality obligations.
Where appropriate, additional confidentiality or data-processing terms will be agreed.
10. Acceptable use
You must not use our website, systems, or services to:
- Break applicable law or infringe another person’s rights.
- Upload malware or harmful material.
- Access accounts, systems, or information without permission.
- Disrupt services or bypass security controls.
- Misuse personal information or send unlawful spam.
- Copy or distribute software beyond the rights granted.
11. Quality and remedies
We will perform services with reasonable care and skill.
If a deliverable materially fails to meet the agreed requirements, notify us with sufficient information to investigate. We will address the issue through correction, re-performance, or another appropriate remedy.
If we cannot complete the project or correct a material failure, an appropriate full or partial refund will be provided for the affected work, while preserving your legal rights.
Additional features and changes outside the agreed scope are assessed separately from defects.
Software may require updates and may be affected by operating-system, browser, device, or third-party changes. We do not guarantee uninterrupted operation or a particular commercial outcome unless expressly agreed.
12. Cancellation and termination
Cancellation requests may be sent to admin@sunswiftsoft.com.
For development cancellations, charges are limited to completed work and authorised, non-recoverable third-party costs. We provide an itemised calculation and refund any unused balance.
Maintenance cancellation notice periods are stated in the accepted maintenance agreement. Unused prepaid balances are refunded after deducting charges properly due.
We may suspend affected work or access where reasonably necessary to address a security threat, unlawful use, material breach, or overdue undisputed payment. Where practicable, we provide notice and an opportunity to resolve the issue.
Termination does not remove accrued rights, confidentiality obligations, ownership rights, or legal remedies.
13. Liability and events beyond control
Each party remains responsible for its conduct to the extent required by applicable law. Any project-specific limitation of liability must be expressly agreed and legally enforceable.
Neither party is automatically excused from all obligations by an event beyond reasonable control. An affected party must communicate the problem and take reasonable steps to reduce its impact.
Prolonged disruption will be addressed through revised arrangements or termination. Payment for services that will not be supplied will be assessed under the Refund and Cancellation Policy.
Nothing excludes liability or consumer rights that cannot lawfully be excluded.
14. Governing law and disputes
These Terms are governed by the laws of India.
Please contact us first so we can attempt to resolve a concern. This does not prevent you from approaching a competent court, consumer commission, regulator, or other lawful forum.
15. Changes
Updates will show a revised effective date. Website changes do not retrospectively alter an accepted project agreement. Material changes to an existing paid engagement require any notice and agreement applicable under the contract and law.
