Refund and Cancellation Policy

Effective date: 30 October 2026 · Last updated: 30 October 2026

This policy explains cancellation and refunds for development and maintenance services supplied by Sunswift Software Solutions, a sole proprietorship owned by Nalla Santosh Choudhury.

GSTIN: 21AIFPC3020R3ZKEmail: admin@sunswiftsoft.comPhone: +91 9517357666Address: Khata No. 24/54, Plot No. 106/219, Tankua, Near Govt. High School, Jeypore, Dist: Koraput, Odisha 764003, India

This policy applies alongside the customer’s accepted quotation or agreement. Specific agreed terms apply where lawful. Nothing limits statutory consumer rights or remedies.

1. Requesting cancellation or a refund

Email admin@sunswiftsoft.com with the subject “Cancellation / Refund Request” and provide:

  • Your name and contact details.
  • The project or maintenance service concerned.
  • Your quotation, invoice, or payment reference.
  • The request and relevant supporting information.

Do not send passwords, OTPs, UPI PINs, or complete payment-card details.

We may request reasonable information to verify the customer, payment, or issue.

2. Cancellation before development begins

If you cancel before work begins, we refund the advance received after deducting only authorised, actual, non-recoverable third-party costs properly attributable to your project.

We provide an itemised explanation of any deduction.

3. Cancellation after development begins

If you cancel after work begins, we charge only for:

  • Work completed up to the effective cancellation date.
  • Authorised, non-recoverable third-party costs.

Completed work is valued using the milestones, rates, or valuation method in the accepted agreement. Where the agreement does not resolve a valuation issue, we will explain the calculation and seek a reasonable resolution.

We provide an itemised statement showing completed work, permitted costs, payments received, and the remaining refund or amount payable.

Advances are not automatically forfeited. Any unused balance is refunded.

4. Project pauses and scope changes

A temporary pause or scope change is managed through an agreement on revised work, charges, and timelines.

A pause does not automatically cancel the project. If required information or approvals remain unavailable, we will contact you before closing the engagement or applying agreed closure provisions.

5. Failure to complete or meet the agreed scope

If a deliverable materially fails to meet the accepted requirements, notify us with enough detail to investigate.

Where appropriate, we will correct the issue, re-perform the affected work, or offer another suitable remedy within a reasonable period.

If we cannot complete the project or correct a material failure, we provide an appropriate full or partial refund for the affected work, while preserving your legal rights.

New features or changes outside the accepted scope are assessed separately from defects.

6. Cancellation by Sunswift

If we cancel for reasons other than your material breach, we refund amounts paid for services we will not supply and arrange handover of paid-for deliverables as applicable.

If cancellation follows an alleged breach, we explain the reason and provide an opportunity to resolve it where reasonable.

Any final settlement accounts for completed work, authorised commitments, payments received, and applicable legal rights. Cancellation does not automatically entitle us to retain the entire advance.

7. Domains, hosting, licences, and third-party costs

Customers may purchase third-party services directly, or authorise us in writing to purchase them on their behalf.

A third-party cost is deducted only where it was authorised, genuinely incurred, non-recoverable, and properly allocated to the engagement.

Provider refund rules may affect recovery of those purchases. We explain the applicable costs and deductions. If a previously deducted amount is later recovered, we account to you for that recovery.

These provisions do not excuse an error by Sunswift or restrict remedies available under applicable law.

8. Maintenance cancellation

Maintenance services are covered by a separate accepted agreement.

You may cancel by emailing admin@sunswiftsoft.com. The agreement states any applicable notice period and the cancellation effective date.

Unused prepaid balances are refunded after deducting charges properly due under the agreement and applicable law.

We explain the effect of cancellation on updates, support, hosting management, or other included services.

9. Duplicate and incorrect payments

We accept bank transfers and UPI payments at launch.

If you believe a payment was duplicated, excessive, or incorrectly allocated, contact us with the reference. We refund any confirmed duplicate or excess amount after verification.

If your bank shows a debit but receipt is uncertain, we assist in tracing the transaction. Bank or UPI-provider reversal times may apply.

10. Decisions and refund timelines

We acknowledge complaints within 48 hours.

We communicate a refund decision, including the calculation and reasons, within seven business days after receiving the information reasonably needed to assess the request, subject to any shorter legal deadline.

Approved refunds are initiated within seven business days after approval. Your bank or payment service may require additional time to credit the amount.

“Business days” means Monday to Friday, excluding public holidays applicable at our business location.

Refunds are ordinarily returned through the original payment route. If that is unavailable, we agree on a secure alternative after verification. We provide a payment reference where available.

We handle tax and invoice adjustments according to applicable law. We do not automatically deduct payment-processing charges; any deduction must be lawful, disclosed, and justified.

11. Digital delivery

Development and maintenance services are supplied digitally. Physical returns and shipping do not apply.

Cancellation, handover, access changes, and deletion of project information are separate matters and are handled under the agreement and Privacy Policy.

12. Portfolio projects and future subscriptions

Sunswift Solar, ULA Data Management, and Expense Tracker are portfolio projects operated by Sunswift Solar. This policy does not govern purchases or refunds handled by that separate operator.

Paid SaaS subscriptions and online checkout are not available at launch. Applicable subscription prices, renewal conditions, cancellation methods, and refund terms will be published before those services become payable.

A pilot will not automatically become a paid subscription without the required customer agreement and authorisation.

13. Complaints and escalation

If you disagree with a decision, email your original reference and reasons for requesting review.

We resolve complaints within one month, subject to any shorter applicable legal deadline.

14. Updates

Updates display a revised effective date. A later policy change will not retrospectively reduce rights attached to an existing purchase.
